1. Payments: a) all applications for a hospitality package including tickets ("hospitality package") and/or advertising and/or sponsorship must be made by completing the booking form in full. A booking form is binding and confirms acceptance of ITFC's terms & conditions. No reservations will be taken without payment details. If payment by approved credit card, payment details must be included/provided at the time of application in order to secure a booking and payment will be taken from the Customer's card immediately. All approved credit card payments are subject to a 1.7% credit card charge. If payment is to be made by debit card, cheque or by bank transfer then all payments must be paid within 30 days of date of invoice b) RPI will be calculated at the prevailing rate and will not fall below 0% c) Tickets and other admission documents will not under any circumstances be issued prior to receipt and bank clearance of full payment except where otherwise agreed in writing by a Director of the Ipswich Town Football Club Ltd ("the Club"). The Club reserves the right to cancel the booking without notice if the Club has not received payment/bank clearance of all payments. Applications may be subject to credit checks undertaken at the clubs discretion.
2. Confirmation: a) Contracts for seasonal packages shall be deemed to have been made on receipt of a fully completed and signed seasonal package booking form. b) The Club reserves the right to omit or amend any part of the seasonal package where necessary and reasonable to do so and where practical will notify the Customer of the change as soon as reasonably possible.
3. Cancellations: In the event of the Customer wishing to cancel or reduce the seasonal package in any way no refund shall be made.
4. Event Cancellation: The Club gives no warranties that any advertised matches shall take place in the time and place stipulated or at all. The Club shall not be liable to give any refund in the event of the match being cancelled or postponed. The Club shall not be liable for any loss, damage, or expense caused by cancellation of a match because of any force majeure incident. In no circumstances whatsoever shall Club be liable for any consequential loss or damage.
5. Resale and Use of Seasonal Packages : a) Seasonal packages and tickets shall not be resold or transferred. b) All advertising and sponsorship copy is subject to approval by the Club and may be rejected by the Club if such copy is deemed not appropriate in the sole opinion of the Club. C) A seasonal booking form that is signed lasts the duration of the season(s) specified on the booking
6. Data Protection; Customer confirms that it has allowed the Club to retain Customer information on the Club's database to be used by the Club's group companies, and passed to selected third parties, to assist in communicating products and services which may be of interest to the Customer by letter, phone, fax, (inc. automatic dialing) email or other electronic means. If Customer wishes to stop receiving such information please inform above the Club office in writing. For training and security purposes telephone calls maybe recorded.
7. Sole and Exclusive contract: This contract constitutes the sole and exclusive contract hereby agreed between the parties, and supersedes all prior oral or written contracts, documents or other arrangements among them, pertaining to the transactions contemplated in this contract. The parties agree that no express or implied representations, warranties, or inducements have been made by any party to any other party except as set forth in this contract. No amendments to this contract are allowed unless agreed in writing by the Club's General Counsel.
8. Law. This Agreement shall be governed and construed in accordance with the law of England.
